PURCHASE RULES

1 Warranty

2 Guarantee

3 Right of replacement

4 Reasonable time

5 The presumption rule

1 WARRANTY

The warranty is the customer’s right to complain about a product that has defects or deficiencies that were present when the goods were sold. The customer has two years to find defects or deficiences in the product proven to be the seller’s responsibility. The burden of proof in the first 6 months lies with the dealer, the next 1 ½ years lies with the customer. Warranty is the customer’s statutory rights.

2  GUARANTEE

Guarantee is a specific agreement between buyer and seller. If the customer and the seller agree that there should be a guarantee period of 2 years for a product, then the customer during this period may complain against all types of defects. It is in this case the seller’s responsibility to prove that the fault is due to neglect by the customer. Guarantee is not the customer’s statutory right.

3 RIGHT OF REPLACEMENT

Consumers may in principle require to swap a product instead of accepting the seller’s offer to get it repaired. It was reversed up to 1 January 2002. However, a very important caveat: The consumer may only require replacement if the swap does not impose undue costs compared to a repair.

4 REASONABLE TIME

In the current law, the consumer always has two months to respond to a fault or defect in a product after it is discovered. A complaint within 2 months is considered within a reasonable time and thus in accordance with the law. Complaints can be made later than 2 months and still be within a reasonable time, but it is rare.

5 PRESUMPTION RULE

The last significant change of the Sale of Goods Act, the so-called presumption rule, which means that within the first 6 months after a purchase it  is assumed that the fault was present at purchase. In practical terms, the rule allows consumers a lighter burden of proof within the first 6 months and in the first 6 months it easier to get the item repaired or replaced.

RIGHT OF WITHDRAWAL

1 The 14 day return

2 To return the goods

3 Sound Returns

4 If in doubt

1 THE 14-DAY RIGHT OF RETURN

If purchased through the Internet, the consumer has 14 days to cancel the purchase.

This right runs from the time of delivery to the consumer. If you wish to revoke the purchase within 14 days we will refund the price.

To use this right, the product must be delivered to the mailing service within 14 days of receipt.

The condition for the withdrawal is that the item is returned in the same condition as at the handover. If the item is returned in the same condition, the value is estimated by CamperLock based on a potential sales value.

If using the right to return, please return in ORIGINAL PACKAGING. Lack of ORIGINAL PACKAGING often leads to a deterioration of sales value, and therefore the basis of an assessment by CamperLock, will be credited with a correspondingly smaller amount equivalent to the depreciation. At worst, failing ORIGINAL PACKAGING etc. may result in the acquisition cannot be undone.

Cost of sending the item back rest with the consumer.

CamperLock will return the money within 30 days in accordance with the Consumer Contracts Act § 12c.
